The Hazardous Waste Branch oversees handling of hazardous waste "from cradle to grave." This involves the promotion of hazardous waste minimization, hazardous waste management and remediation of hazardous waste releases through permitting, corrective action, registration and reporting requirements.

Dry Cleaners and RCRA--This publication is to assist you with your concerns about dry cleaners and Resource Conservation and Recovery Act (RCRA). It is intended for informational purposes only and cannot be substituted for the regulations themselves. In order to assist dry cleaners in Kentucky with regulatory compliance, the Hazardous Waste Branch has developed this publication to provide the applicable regulations, recordkeeping and reference information in one document for the convenience of facility owners and operators.
TOS Requirements--For treatment on-site (TOS) activity, the facility must submit an official request to treat waste on-site pursuant to
401 KAR 32:030 Section 6.
Hazardous waste regulations – The Energy and Environment Cabinet has updated Hazardous Waste Program regulations, effective June 13, by referencing Federal Hazardous Waste Regulations as codified on July 1, 2005, in addition to language that is specific to Kentucky. The revised Kentucky administrative regulations – 401 KAR Chapters 30-38, 43 and 44 – are online at the

I. Administrative Support Section - This section registers and issues EPA identification numbers to hazardous waste generators, transporters, recyclers, universal waste handlers and used oil handlers; administers the hazardous waste assessment program and the annual report program; conducts and provides data management for the hazardous waste program; and evaluates financial assurance submittals from hazardous waste management facilities.
II. Permit Review Section - This section reviews all hazardous waste permitting actions and closure plans to verify that they are in compliance with all applicable laws and regulations.
III. Corrective Action Section - This section is responsible for the review and oversight of characterization and cleanup plans and reports for hazardous waste management facilities where hazardous waste has been released into the environment. Section personnel also review groundwater monitoring plans for hazardous waste facilities, and they review post-closure permit applications and prepare permits for hazardous waste land disposal units.
IV. PGDP Section – This section oversees the U.S. Department of Energy's (DOE) environmental cleanup of the Paducah Gaseous Diffusion Plant (PGDP) in western Kentucky. The section has two distinct oversight roles, the Federal Facility Agreement (FFA) and the Agreement-In-Principle (AIP). The Federal Facility Agreement outlines the relationship between DOE and Kentucky. The FFA concerns regulatory cleanup requirements. The Agreement-In-Principle focuses on the nonregulatory aspects of the environmental conditions and effectiveness of the overall cleanup programs.
V. BGAD Section - This section oversees the activities of the Blue Grass Army Depot (BGAD) and its tenant Blue Grass Chemical Activity (BGCA) in Richmond, Ky. In particular, the section deals with the storage and destruction (or demilitarization) of chemical weapons located in the chemical activity. The section oversees construction and operations of the depot's demilitarization facility, Blue Grass Chemical Agent-Destruction Pilot Plant (BGCAPP), to ensure compliance and to protect human health and the environment.
