This report shows all evaluations that discovered violations and determines if proper enforcement is being conducted in a timely and appropriate manner. For each evaluation/violation pair, the report shows the first informal enforcement action and the first formal enforcement action that was taken. For both the informal and formal enforcement action, the days elapsed is calculated for the time from when the evaluation was performed to when the enforcement action was executed. If there has been no enforcement action, the days elapsed is calculated from the evaluation date to the date returned to compliance, or lacking that, to the date the report was run.

Evaluations that are not "timely" are highlighted, where more than 180 days have elapsed for a formal enforcement action (enforcement action > 200), with the exception of referring to attorneys or DOJ (enforcement action 415) which is allowed 210 days, and entering a final consent order (enforcement action 380), which is allowed 300 days. 

Key Elements

·         Evaluation Date: The first day of the inspection or record.

·         Activity Location: The location of the agency conducting the evaluation. 

·         Evaluation Type: The type of evaluation conducted at the handler.

·         Violation Date: Date that a determination is made that a violation exists.

·         Activity Location: The location of the agency regulating the activity.

·         Violation Area: The specific monitoring requirements area of a handler which is evaluated and found to be in violation with RCRA regulations

·         RTC Date: The date the agency determines that the handler demonstrated full physical compliance.

·         Enforcement Date: The date the enforcement action was issued.

·         Enforcement Location: The location of the agency regulating the activity

·         Enforcement Type: The type of action being taken against a handler
