Below are some important facts that hazardous waste generators must know to operate in Kentucky.
If you are a... You may generate…
Large Quantity Generator; Over 2,200 pounds of waste per month.
Small Quantity Generator; Between 220 and 2,200 pounds of waste per month.
Conditionally Exempt Small Quantity Generator; Less than 220 pounds of waste per month.
Do you need an EPA ID number?
If so, file Form DEP-7037.
EPA ID numbers are site specific, so if you move to a new location, you must apply for a new ID number.
If you are a conditionally exempt small quantity generator, it is not a regulatory requirement to register or have an ID number. However, if you need one for your disposal company, we will issue an EPA ID number upon completion of the registration form. As a Conditionally Exempt Small Quantity Generator, you are exempt from all other reporting and renewal requirements unless you are also a recycler.
All Large and Small Quantity Generators must:
1. Renew their EPA ID number annually (on a schedule determined by the Division);
2. File an Annual Report by March 1 of each year;
3. File an Assessment Return by March 1 of each year;
4. File a modified registration form within 30 days whenever such things as contact person or waste streams change, even if the new waste is only a one-time shipment.
Generators have the option of handling certain wastes, such as batteries, pesticides, thermostats and spent lamps as hazardous waste or universal waste. (See 401 KAR Chapter 43 for specific requirements for universal waste).
Large Quantity Generators are required to have a contingency plan, while Small Quantity Generators are not.
Generators are allowed to treat their waste on-site with prior approval, including registration and the appropriate fee (see 401 32:030 Sect. 6).
Used oil handlers are required to file a one-time registration including the $300.00 fee.
Transporters of hazardous waste are required to have an EPA ID number and file a one-time only registration with this agency. (There is no fee for transporters.)
Fees must be submitted with the appropriate registration form.
Your check must be made payable to the Kentucky State Treasurer and mailed to this agency with your form.
Each form submitted to the Division of Waste Management must be complete and have an original signature. (Form Number DEP-7037, Revised October 2000)
