Registration

 

All underground storage tank (UST) systems located in the Commonwealth must be registered with the UST Branch unless the tank system is exempt from UST regulations.  If you own a UST system that is not exempt, you must complete, sign and submit the UST Facility Registration Form DEP 7112 (August 2006).  Carefully follow all directions on the instructions page.  Information submitted on this form is used for determining important items including the following:

  • Ownership of a UST System
  • Financial Responsibility
  • Eligibility to participate in the Petroleum Storage Tank Environmental Assurance Fund (PSTEAF)

 

Once received by the UST Branch, the registration form will be reviewed for completeness.  If the information is complete and the owner or operator (applicant) is eligible to participate in the PSTEAF, the UST Branch will issue a Certificate of Registration and Reimbursement Eligibility, DEP 7113 (August 2006) (CORRE). 

 

Exempt Tanks: To determine if your tank system is exempt, see the Exempt Tanks Chart.  Exempt tank systems may need to be registered with another agency. 

 

Change in Ownership: If ownership of the UST system changes, a new UST Facility Registration Form DEP7112 (August 2006) must be filled out within 30 days of the change in ownership and submitted to the UST Branch.  The form must be signed by the new owner(s).  The most recently submitted registration form supersedes all previously submitted registration forms for the UST facility.

Annual Tank Fees

 

Each UST that contained product after July 1, 1990, will be assessed a $30 annual tank fee on July 1 of each year.  The current owner is responsible for tank fees to be paid yearly.  If ownership is taken of a UST facility that has outstanding tank fees, the new owner is responsible for those fees.  If tank fees are delinquent enforcement action may be taken.

Other Fees for USTs

 

The Department of Agriculture, Division of Regulation and Inspection requires an annual fee per site per year.  They may be contacted at 502-564-4870.

 

The Office of the State Fire Marshal requires an application and permit if tanks are upgraded and/or new ones are installed.  They may be contacted at 502-573-1702.

Open Records

 

An accurate historical record for the general public to reference is available in the UST Branch file room.  Items found in the file room consist of all correspondence from the tank owner to the UST Branch as well as all information submitted regarding the facility.  In addition, information concerning the eligibility, approval and reimbursement through the PSTEAF is found in the UST Branch file room.

 

Information in the UST Branch file room is available for public inspection per KRS Chapter 61.  Unless the material is exempt from disclosure pursuant to KRS 61.878, this office must respond to an open records request within three working days from the date the request is received by the USTB.

 

Anyone may request an inspection of UST Branch records.  All requests must be written per Kentucky law.

Request to inspect UST Branch records by submitting the completed Open Records Request Form to the Open Records Custodian. This can be accomplished via an e-mail to ust.kora@ky.gov or sending a completed Open Records Request Form to:

The written request should contain all information known about the property/facility in question to ensure that the information being requested can be found in a timely manner.  Examples of information needed, depending on the request, could include the following:

  • Facility information: owner’s name, physical address, name, identification number, etc.
  • Agency interest number
  • Owner or operator Certificate of Eligibility (CofE) number, if applicable and in the Financial Responsibility Account (FRA)
  • Owner or operator file number if in the Petroleum Storage Tank Account (PSTA), if applicable
  • Application for Assistance number, if applicable
  • Claim Payment Request number (i.e., #1, #2, #3, etc.) and the Application for Assistance number, if applicable
  • Small Owner Tank Removal Account (SOTRA) number, if applicable

Copies may be made at the UST Branch office during a file review at a cost of 10 cents per page or you may request a list of off-site vendors that will come in and copy the file information for you.  The UST Branch does not keep cash on the premises for change so bring bills and change or a check or money order payable to Kentucky State Treasurer as needed.  Credit cards are not accepted for payment for making copies.
