USTB Certified Company Program

The 1998 Kentucky General Assembly amended KRS 224.60-130(2)(a) to require the Petroleum Storage Tank Environmental Assurance Fund (PSTEAF) to establish criteria for the certification of companies and partnerships that engage in corrective action at petroleum underground storage tank (UST) facilities.  These criteria apply to any company or partnership that plans to contract with an owner or operator to perform corrective action work at petroleum underground storage tank facilities under an Application for Assistance filed with this agency on or after July 1, 1999.

To be eligible to contract with a petroleum UST owner or operator seeking reimbursement from the Financial Responsibility Account (FRA) or the Petroleum Storage Tank Account (PSTA), a company or partnership must conform to the requirements set forth in 401 KAR 42:316 relating to certification of contracting companies and partnerships.  A company or partnership seeking this type of certification should submit a completed Certified Company or Partnership Application to the UST Branch for review and possible approval.

Instructions for filling out the Certified Company or Partnership Application Form

  1. This application form is to be used by companies and partnerships seeking certification, pursuant to 401 KAR 42:316, to perform corrective action work under an Application for Assistance submitted to UST Branch on or after July 1, 1999.
  2. Review the instructions carefully under each part of the application and provide the information required.  If a question in the application is not applicable, please indicate by inserting the letters "NA."  Responses in the application may be printed or typed.  Applicants may computer-modify this form to meet their particular needs for providing the required information.
  3. Do not submit an application in a plastic combed or three-ring binder or notebook.  Applications can be stapled in the upper left-hand corner or a binder clip may be used.
  4. The cabinet may inspect facilities of the applicant pursuant to 401 KAR 42:316.
  5. Additional information may be requested by the cabinet pursuant to 401 KAR 42:316.
  6. An application may be denied for those reasons specified in 401 KAR 42:316.
  7. An original signature of an officer, director or principal must be provided in Part 21 of the application.
  8. An original and one copy of the completed application form must be submitted to: Ericka Seay, Underground Storage Tank Branch, 81 C. Michael Davenport Boulevard, Frankfort, KY 40601.
