The 1998 Kentucky General Assembly amended KRS 224.60-130(2)(a) to require the Petroleum Storage Tank Environmental Assurance Fund (PSTEAF) to establish criteria to certify laboratories providing analytical services under the commonwealth’s Underground Storage Tank (UST) Program. Pursuant to 401 KAR 42:340, after Oct. 1, 1999, owners and operators shall have all required analytical testing performed by a certified laboratory to be eligible for reimbursement from the funding source, the PSTEAF. This administrative regulation does not apply to a facility for which the Claims and Payment Section approved an Application for Assistance prior to Oct. 1, 1999, unless further analytical sample testing is required by the cabinet after Oct. 1, 1999.
After a current accreditation has been obtained, an accredited laboratory needs to submit to the UST Branch's Claims and Payment Section a completed Application for Laboratory Certification (DEP 6074). The application has to include proof of accreditation from one of the approved accreditation laboratory programs listed in the Requirements section below.

A laboratory can apply for certification after obtaining a current accreditation from:

(2) The National Environmental Laboratory Accreditation Program (NELAP) is the program that implements the National Environmental Laboratory Accreditation Conference (NELAC) standards. State and federal agencies serve as accrediting authorities with coordination facilitated by the Environmental Protection Agency (EPA) to assure uniformity.
