Responsibilities of  the Administrative Section

1. Reviews and processes the UST Facility Registration Form DEP7112/08/06 that is received for new installations, change of ownership, financial responsibility and various technical information updates for every non-exempt underground storage tank system (Exempt Tanks Chart) located in the commonwealth of Kentucky.

 

2. Collects annual registration fees.

 

3. Provides assistance for information requests received for open records (e.g., requests to view files, requests for lists of active facilities, etc.) and listings for all registered underground storage tanks (UST).

 

4. Maintains the UST Branch's database and file room.

 

Applying for Financial Responsibility

Owners and operators of regulated petroleum UST systems are required to show proof that they have $1 million in pollution liability insurance and $1 million in third-party liability insurance by federal and state regulations.
 
1. Complete and submit a UST Facility Registration Form DEP7112/08/06 to apply for pollution liability coverage for regulated motor fuel UST system(s) as described in KRS 224.60-140. This form shall be completed prior to submitting an Application for Assistance.
 
2. Once this form is received by the UST Branch, it will be reviewed for eligibility and potential account placement. 
 
3. A Certificate of Registration Reimbursement and Eligibility DEP7113 (CORRE) will be issued if the owner or operator (applicant) is eligible to participate in the Petroleum Storage Tank Environmental Assurance Fund (PSTEAF).
  

Assessment of Annual UST Fees

Each UST that contained product after July 1, 1990, shall be assessed a $30 annual tank fee on July 1 of each year.

 

Registration Process for Regulated USTs

1. All UST systems located in the commonwealth shall be registered with the UST Branch unless the tank system is exempt from UST regulations. However,those tank systems may need to be registered with another agency.  See the Exempt Tanks Chart to determine if your tank system is exempt and what agency is responsible for that tank system.

 

2. The owner of a UST system shall complete, sign, and submit the UST Facility Registration Form DEP7112/08/06. This form is incorporated by reference in 401 KAR 42:020.

 

3. When a change in the ownership of the UST system occurs, a new UST Facility Registration Form DEP7112/08/06 signed by the new owner(s) shall be submitted to the UST Branch within 30 days of the change. The latest UST Facility Registration Form DEP7112/08/06 submitted always supersedes all previously submitted UST Facility Registration Form DEP7112/08/06.


Open Records Request

The UST Branch's file room maintains an accurate historical record for branch employees and the regulated public to reference.  Items found in the file room consist of all correspondence from the tank owner to the UST Branch as well as all information submitted regarding the facility.  In addition, information concerning the eligibility, approval and reimbursement through the funding source, the PSTEAF, is found in the UST Branch's file room.


1. The information in the UST Branch file room is available for public inspection per KRS Chapter 61.  Unless the material is exempt from disclosure pursuant to KRS 61.878, this office must respond to a Request to Inspect Open Records Form, which is commonly referred to as an "open records request," within three working days from the date the request is received by the UST Branch.

 

2. The request should contain all information known about the property/facility in question to ensure that the information being requested can be found in a timely manner.  Examples of information needed, depending on the request, could include the following:

  • Facility information: owner’s name, physical address, name, identification number, etc.
  • Agency interest number.
  • Owner or operator Certificate of Eligibility (CofE) number, if applicable and in the Financial Responsibility Account (FRA).
  • Owner or operator file number if in the Petroleum Storage Tank Account (PSTA), if applicable.
  • Application for Assistance number, if applicable.
  • Claim Payment Request number (i.e., #1, #2, #3, etc.) and the Application for Assistance number, if applicable.
  • Small Owner Tank Removal Account (SOTRA) number, if applicable.

 

3. Kentucky law requires citizens to complete (in writing) all requests to view public records.  For any reason unless information is considered exempt as described in Item 1, anyone may request an inspection of the UST Branch's records by completing a Request to Inspect Public Records Form and setting up an appointment to view the records.

 

4. Open Records Requests may be made by fax 502-564-0094 or via e-mail at UST.KORA@ky.gov.  In addition, an appointment to view the information requested may be made by calling 502-564-5981 or 800-928-7782 and asking for a file room custodian.

 

5. Copies may be made at the UST Branch office during a file review at a cost of 10 cents per page, or you may request off-site vendors who can copy the file information for you.  The UST Branch does not keep cash on the premises for change.  Please ensure that you bring bills and change if paying in cash, or a check with you to pay for copies.
