Kentucky Revised Statute (KRS) 61.870, the Open Records Act, defines a public record as: all books, papers, maps, photographs, cards, tapes, discs, diskettes, recordings or other documentary materials regardless of physical form or characteristics, which are prepared, owned, used in the possession of or retained by a public agency.
Anyone may request an inspection of the cabinet’s records provided the material is not exempt from disclosure under KRS 61.878. The cabinet must respond to a open records request within three working days after the request is received.

Upon receiving completed open records applications, the PSTEAF open records officer has three days to respond to the applicant. The open records officer will then obtain the requested records for examination or create a query, whichever is appropriate.
When the requested files have been obtained, the open records officer will then contact the individuals making the request and schedule a date and time for the records examination.
On the agreed examination date, individuals requesting the open records will need to examine the files in the location the open records officer has established for file review.
Individuals may request copies of any or all material available for examination at a cost of 10 cents per page. If a database query is needed to retrieve information electronically the cost is an additional $25 per query. It is up to the open records officer to determine if copies will be made at the time of the examination or at a later date. This decision will be based upon the amount of material to be copied and the time needed to make such copies. If copies cannot be made at the time of the examination, arrangements will be made to mail the material to the requesting individuals. An invoice will be mailed to the individual for the related charges.
