Used Oil - Release and Cleanup Requirements

NOTE: This page addresses only the highlights of the regulations for the above topic. Please refer to the appropriate Kentucky regulations and statutes for additional information.

When used oil is spilled or released, it can threaten human health, safety and the environment. The heavy metals and contaminants in used oil can leach into the groundwater or drinking water. When a release is confirmed or even suspected, it is important to act responsibly and take the necessary actions to minimize this threat.

When a release occurs, the following tasks should be performed:

1. Stop the release.
2. Contain the used oil spill and minimize further migration.
3. Clean up and properly manage the released used oil and other materials.
4. Prevent future releases by repairing or replacing leaking or defective used oil containers and/or tanks and associated piping.
5. If the release is more than 25 gallons in a 24-hour period, report the release immediately to the 24-hour Environmental Response telephone number:

(502) 564-2380 or (800) 928-2380

6. Perform corrective action and remedial measures to restore the environment to acceptable conditions. For releases from underground storage tanks, site characterization and restoration must be conducted in accordance with the regulations of the UST program. For all other releases, activities must comply with the requirements of the Kentucky Superfund Program.
